Terms and Conditions

DEPOSIT & PAYMENT

  1. For bookings made more than 60 days prior to the arrival date, a 50% non-refundable deposit is required to confirm the reservation.
  2. Until the 50% deposit is paid, we cannot guarantee the booking on your behalf.
  3. If you book your stay within 30 days of the arrival date, full payment of the property rental is required.
  4. After paying the 50% deposit, if the remaining balance is not paid 30 days prior to your arrival date, we reserve the right to cancel the booking in accordance with our cancellation charges. Top Notch Villas will not be held responsible for any failure to make the final payment.
  5. Upon arrival at the property, you will be required to pay a cash security deposit. This deposit serves as security against any damages or charges that may arise during your stay and will be equivalent to one day’s rent.
  6. The number of guests in your party must be clearly stated at the time of booking and must not exceed this number during the rental period. We reserve the right to refuse entry to your party or terminate the rental without prior notice if this condition is not met.
  7. Unreasonably noisy or poorly behaved guests may be asked to leave the property without reimbursement, at the discretion of Top Notch Villas in Sri Lanka.

 

PAYMENTS

  1. All payments must be made in USD or LKR.
  2. All payments due must be made in full.
  3. Any bank charges related to the transfer of funds must be borne by the person making the booking and not by Top Notch Villas.
  4. All payments must be made online, and a 15% VAT will be added to the agreed rental price for the property.

CANCELLATION

  1. Cancellations must be submitted in writing via email.
  2. In the event of a no-show, all payments made will be forfeited.
  3. If you cancel your booking for any reason, the 50% deposit is non-refundable. Any remaining balance payment will be returned to you, less handling charges.
  4. In the very unlikely event that we need to cancel your booking prior to your arrival date, you will be entitled to a full refund of all monies paid.

RENTAL TERMS

  • By paying the booking amount in full, you agree to all terms and conditions.
  • You are entitled to occupy the specified property for the full period booked, subject to the following conditions:
      1. The property and its contents must be left in the same condition as when you arrived.
      2. You agree not to make any changes or alterations to the property or its contents during your stay.
      3. You also agree not to damage the property or its contents, or remove any items that do not belong to you.
      4. You agree to use the property solely as a holiday villa and for no other purpose.
      5. You may not use the property for commercial purposes or hold any events without prior written consent from a representative of Top Notch Villas.
      6. You may not sublet the property or allow any persons other than those declared at the time of booking to stay at the property without prior written agreement from Top Notch Villas.
      7. You may only use the facilities within the villa you have rented and are not permitted to enter any other annexes at any time.
      8. You agree to report any damaged or soiled items belonging to the property to the staff and, if necessary, to cover the cost of cleaning or repairing these items.
      9. You agree to allow Top Notch Villas representatives to enter the property during your stay, with reasonable notice, to assess or carry out any necessary repairs.
      10. You will not request that staff leave the property except when carrying out their duties, such as shopping on your behalf.
      11. Please refrain from requesting any form of credit from the staff during your stay.
      12. Any items you wish the staff to purchase must be paid for in cash before the receipt of the goods or services.
      13. Staff must always be present on the property.

INSURANCE

  • We strongly recommend that all parties staying at the villa have their own comprehensive travel insurance, including coverage for personal effects, injury, and medical needs.
  • Top Notch Villas will not be held responsible for any financial loss or damage to guests’ personal items, or for any injury sustained by them or any member of their party while staying at our properties.

CHECK IN - CHECK OUT

  • Please arrive at the property after 14:00 to allow the staff adequate time to prepare for your arrival.
  • Upon arrival, a security deposit equivalent to one day’s rental will be requested in cash.
  • On departure, please vacate the villa by 11:00 am. If this is not possible, we will do our best to assist, including moving luggage and arranging vehicle packing.
  • Your security deposit will be refunded after we inspect the villa for any damage or breakages, prior to your departure.

LIABILITY

  • Travel insurance covering illness, injury, death, damage, loss, and cancellation during your holiday is highly advisable.
      1. Top Notch Villas is not liable under any circumstances to substitute or refund any unused portion of accommodation or related services.
      2. Top Notch Villas is not liable for any damage, loss, injury, or death sustained by clients, whether inside or outside the villa.
      3. While we make every effort to ensure the accuracy of the information presented on our website, we are not responsible for any changes or alterations made by the villa owner.
      4. Top Notch Villas is not responsible or liable for any related expenses that may arise from inconvenience caused by the state or condition of the villa.
      5. Top Notch Villas is not liable for any loss or damage to personal belongings of clients and their visiting guests, including cars and items left inside the property.

COMPLAINTS

  • Both Top Notch Villas and the villa owners strive to provide comfortable accommodation for our clients. However, occasionally issues may arise that are beyond our control and could negatively affect your holiday experience.
      1. Clients should address any complaints to the villa manager immediately.
      2. Neither the villa owner nor Top Notch Villas will entertain any complaints raised after the client’s departure.
      3. Top Notch Villas is not liable for failure to perform its obligations due to issues beyond its reasonable control, including but not limited to acts of God, power failure, fire, flood, epidemic disease, war, riot, and terrorism.
